Hydrofinity Privacy Policy

The content, resources, and services provided to customers and third-party vendors at hydrofinity.com, including all pages hosted at our domain (the “Site”), are owned and operated by Hydrofinity. We respect your privacy and are committed to protecting it through our compliance with this Privacy Policy (the “Policy”).

This Policy describes the type of information we may collect or that you may provide when you access or use our Site or our services, including without limitation the Hydrofinity Connect services (collectively, the “Service” or “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Please read this Policy and our Terms of Use carefully to understand our practices and how we may use your information. If you do not agree with this Policy or our Terms of Use, do not register with or use the Site or our Services. By registering with or using the Site or our Services, you agree to be bound by the terms of this Policy.

While our Site may contain links to other third party websites, this Policy does not apply to those websites or to the information that you may provide to or that is collected by any third party. These third parties may have their own privacy policies, which we encourage you to read before providing any information or accessing any third party links or websites.


Our Site and Services are not intended for children under 13 years of age, and we do not knowingly collect Personal Information (as defined in Section II, “Information We Collect and How We Collect It,” below) from children under the age of 13. If we learn that we have collected or received Personal Information from a child under the age of 13 without verification of parental consent, we will delete that information. We cannot always determine if a user of our Site or Services is under the age of 13, but we will exert commercially reasonable efforts to do so.


When you register with or use our Site or Services, we may ask you to provide information that may personally identify you, such as your name, mailing address, company name, title, email address, telephone number, or other information that is defined as personal or personally identifiable information under applicable law (“Personal Information”), which may be required by us to provide the Services or may be disclosed by you during your use of our Site or Services.

We may collect and process the following data:

  • Information you provide to us by completing forms on our Site, including, information you provide if you register to use the Site and our Services;

  • Information you decide to share by using our Site and Services, including, your search queries on the Site;

  • Information you provide to us when you contact us for customer or technical support or when you submit questions or comments; and

  • Information you provide to us when you participate in promotions, customer surveys, or other offers.

Please be aware that no security measures are perfect or impenetrable. We cannot and do not guarantee that the information that you share will not be viewed by unauthorized persons. We are not responsible for the Personal Information or any other information that you choose to share. 


How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.


When you access and use our Site or Services, our servers may automatically collect and store:

  • Certain details of your access to and use of our Site and Services, including traffic data, date and time of access, geolocation data, domain name, and other communication data about your access to and use of our Site;

  • Information about your internet connection, including your device's unique device identifier, the type of device, IP address, operating system, browser type, browser signatures, and network information;

  • Additional information from users of Hydrofinity Connect, (see Section VII, “Registered Users and Hydrofinity Connect, Users,” below).

If you do not want us to collect this information, please change your browser settings or refrain from using our Site or Services. 


The technologies we use for automatic information collection include cookies and web beacons. A cookie is a small file placed on your device. It may be possible to refuse to accept cookies by activating the appropriate settings on your device. Our Site may also contain small electronic files known as web beacons that allow us to count users who have visited certain pages. Use of cookies and web beacons allows us to compile usage and other Site statistics, monitor traffic patterns, calculate total visits, and ensure that visitors see the webpage variant that they expect to see.

Your use of the Site and Services is deemed an acceptance of our use of cookies, web beacons, and other tracking technologies. If you disable or refuse cookies or block the use of other tracking technologies, some parts of our Site may be inaccessible or not function properly. We are not responsible for any adverse effects arising from your refusal to accept the use of cookies or other tracking technologies.

We may disclose, without restriction, aggregated, de-identified, or anonymized information about our users and any information that does not identify a particular individual.

In addition, we may disclose information that we collect or you provide:

  • To our subsidiaries and affiliates;

  • To Third Party Vendors, subcontractors, authorized service providers, and other third parties we use to support our business;

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information or other information held by Hydrofinity about our users is among the assets transferred;

  • To third parties, direct mail partners, and advertisers to market their products or services (unless you have unsubscribed or opted out);

  • To fulfill the purpose for which you provided the information;

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;

  • To enforce our rights arising from any contracts entered into between you and us;

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Hydrofinity, our customers, Site users, or others; and

  • For any other purpose disclosed by us when you provide the information or upon receiving your consent.


Users of Hydrofinity Connect may be asked to create an account and register to use our Services. Registering for and creating an account constitutes your implied consent to receive electronic marketing communications from us regarding our Services, products, news, and other offers or promotions. You also agree that we may communicate with you to manage your account and provide you with notices about your account.

For Hydrofinity Connect users, we may also collect information about your machine utilization data, including, water usage, utility usage, chemical usage, labor and machine efficiency, and other metrics. We may disclose, without restriction, aggregated, de-identified, or anonymized information about such users, their machines or devices, and any information that does not identify an individual, machine, or device. We may use this aggregate, de-identified information to create reports and analyze trends about users, their machines, and devices and to communicate with you regarding performance and usage data. All data, information, and metrics collected through Hydrofinity Connect is and shall be the sole and exclusive property of Hydrofinity and its affiliates.

You may opt out of our collection of this information at any time by emailing us at info@hydrofinity.com. Note, however, that opting out of our collection of certain information may disable or cause certain features of our Services to not function properly. If you are a registered user, you can also review and change your privacy and user settings by logging in and adjusting your preferences in your account profile.

You may request that your account be deleted by emailing info@hydrofinity.com


You have a choice about how we use your information to communicate with you. You may send us an email at info@hydrofinity.com to request a copy, make a correction, access, or delete any Personal Information that you have provided to us. If you are a registered user, you may opt out of our use of your information by deleting your account or changing your user preferences.

We may not accommodate a request to change or delete information if we believe the change or deletion would violate any law or legal requirement or cause the information to be incorrect.


We have implemented reasonable physical and technical safeguards designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you or where you have chosen a password for access to our Site, you are responsible for keeping this password confidential.

Unfortunately, the transmission of information via the internet is not completely secure. Although we use commercially reasonable measures to protect your information, we cannot guarantee the security of any information transmitted through our Site. Any transmission is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures we may provide.


This Policy may change from time to time in our sole discretion. A revised version of this Policy will be posted on our Site with a notice that it has been updated. Your continued use of our Site or Services after changes to this Policy are made is deemed an acceptance of such updates or changes.
